Agreement

These terms govern your use of the websites, software, and services provided by FSS Group LLC ("FSS Group," "we," "us"), a Florida limited liability company located at 2575 NE 214th St, Miami, FL 33180. By purchasing or using our services, you agree to these terms.

Services

Depending on the plan you select, we provide some or all of the following:

Design, build, and hosting of a website for your business.
Automated missed-call text-back and lead follow-up.
Automated review requests.
A shared inbox for calls, texts, and messages.
An AI phone answering service, on plans that include it.

We may improve or modify features over time. We will not materially reduce the core services you are paying for without notice.

SMS messaging program

FSS Group LLC operates an SMS messaging program for business owners who have given us express consent to be texted. Messages include a link to the sample website we prepared for your business, scheduling for a follow-up meeting, and replies to questions you have asked. Message frequency varies, and is typically fewer than five messages per month.

To opt out, reply STOP to any message from us. You may also text STOP to the number that contacted you. After you send STOP we will send one confirmation message and then stop texting you. To rejoin, reply START. For help, reply HELP or email admin@fssgroup.org.

Message and data rates may apply. Your mobile carrier's standard message and data rates apply to every message you send or receive, including STOP and HELP requests. We do not charge you for the messages themselves.

You must be 18 years of age or older to consent to receive text messages from FSS Group LLC. We do not knowingly send marketing text messages to anyone under 18.

Consent to receive text messages is never a condition of purchase, and is collected separately from any other agreement. Carriers are not liable for delayed or undelivered messages. Mobile information and consent are never sold or shared with third parties for their own marketing purposes — see our Privacy Policy for details.

Fees and billing

A one-time setup fee is due before work begins.
Monthly service fees are billed in advance, on the same day each month.
Fees are non-refundable except as required by law or as expressly stated here.
Plans are month-to-month with no long-term contract.
We may change pricing with 30 days' written notice.

If payment fails, we may suspend services after notifying you. Extended non-payment may result in cancellation.

Cancellation

You may cancel at any time by emailing admin@fssgroup.org. Cancellation takes effect at the end of your current billing period. We do not prorate partial months.

Your website and your phone number stay yours. On cancellation we will provide your website files and release your phone number for transfer, at no charge, if you request it within 30 days.

Your responsibilities

Provide accurate business information, and keep it current.
Hold the rights to any logos, photos, text, or other content you give us to publish.
Use the services lawfully, including compliance with all applicable telemarketing, messaging, and privacy laws.
Keep your account credentials secure.

You are responsible for the content of messages sent to your own customers through the platform, and for having proper consent to contact them.

Acceptable use

You may not use our services to send unsolicited bulk messages, to send unlawful, deceptive, harassing, or infringing content, or to attempt to gain unauthorized access to our systems. We may suspend services immediately for violations of this section.

Intellectual property

You retain ownership of your business name, logo, and content. On full payment, you own the website we build for you. We retain ownership of our underlying templates, tooling, and platform, and we may use non-confidential work in our portfolio unless you ask us not to.

Third-party services

Our services depend on third-party providers for hosting, telephony, messaging, and email delivery. Their outages, policy changes, or carrier decisions can affect service, and those are outside our control.

Service availability

We work to keep services available continuously but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, carrier issues, and events beyond our reasonable control may cause interruptions.

Disclaimers

Services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee any particular number of leads, calls, bookings, reviews, or revenue.

Limitation of liability

To the fullest extent permitted by law, FSS Group's total liability arising out of or relating to the services is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business.

Indemnification

You agree to indemnify and hold FSS Group harmless from claims arising out of content you provide, your use of the services, or your violation of these terms or applicable law.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Broward County, Florida.

Changes to these terms

We may update these terms. Material changes will be reflected in the "last updated" date above, and continued use of the services after a change constitutes acceptance.
